Looking at the Artistic License it seems pretty sloppy; it is not clear if the author waives copyright claims provided certain conditions are met. I can see the defendant claiming that all conditions of the license have been met and that they have therefore not violated the author's copyrights.

The idea behind the GPL (at least what is apparent from version 2) is that a party enters into a contract under which the copyright holder grants certain freedoms. If the contract conditions are not met then there is not only a contract violation but a copyright violation as well. The Artistic License is far from clear on that point.

I guess we wait and see what the judge thinks.
