Microsoft's Lindows Lawsuit Could Backfire, Jan 18, 2002
To retain a trademark, a company must actively pursue those that violate it. Lindows.com's legal strategy is to play the trademark abandonment card. Using this strategy, the company will likely show that Microsoft has allowed a wide array of companies to use variants of the Windows name, thus making Microsoft's suit without merit, because the trademark has been effectively abandoned.
Microsoft runs the risk of losing its Windows trademark altogether if Lindows.com is successful with this strategy.
